Sarkari Chakori Ain, 2018: TIB demands review

The Transparency International Bangladesh (TIB) has urged the authorities to review the proposed provision in the draft of the 'Sarkari Chakori Ain, 2018' that says prior permission is mandatory for arresting any public servant before framing charge sheet.

The anti corruption watchdog also termed the provision as anti-constitutional and discriminatory in a statement on Monday.

The TIB expressed its concern as it thinks the provision would be an obstacle to ensure transparent, people friendly and accountable administration in the country.

TIB executive directive Iftekharuzzaman said, “The proposed provision in the draft act is considered to be anti constitutional and discriminatory as it bears different status for same offence between general people and public servants.”

In the draft act, there is no necessity of taking prior permission for arresting ordinary people and public representatives.

"But the proposed provision keeps prior permission for public servants—which is anti-constitutional," he said.   

The proposed provision is also contradictory to the 54 section of country’s Code of Criminal Procedure, 1898, he added. 

Besides, the proposed provision has also taken position against the honesty, transparency, professionalism and neutrality in the country’s administration.
