Attorney general says he can contest polls while in office

Attorney General Md Asaduzzaman has said there is no legal barrier to his participation in the upcoming national elections while holding his current post, arguing that the country's top law officer is not a government employee under the Constitution.

Speaking to reporters at his office on Thursday, Asaduzzaman said Article 64 of the Constitution clearly defines the Attorney General as the state's legal representative, not a government servant, and therefore eligible to run for office while still in post.

He dropped a broader hint that he intends to contest the election while serving as the state's chief legal officer.

"I see no problem," he told reporters at his office.

"The Attorney General is not a servant of the government. According to Article 64 of the Constitution, the Attorney General is the lawyer of the state, not a government employee. Therefore, the Attorney General is free to contest in the election while holding the position. There is no ambiguity on this issue - it is a settled matter of law."

On Wednesday, Asaduzzaman announced his intention to resign from his post to contest the national election as a Bangladesh Nationalist Party (BNP) candidate from the Jhenaidah-1 constituency.
