The High Court (HC) has issued a rule, asking why no action should be taken to evict 179 illegal brick kilns in the district.
It has sought to know why the defendants' inaction to remove the brick kilns should not be declared illegal as per the Brick Kiln Preparation and Kiln Installation Control Act 2013.
The secretary of the Ministry of Agriculture, the secretary of the Ministry of Local Government, the secretary of the Ministry of Environment and Forest, the director general of the Department of Environment and the deputy commissioner of Gaibandha have been asked to respond to this rule within the next four weeks.
An HC bench consisting Justice Khasruzzaman and Justice AKM Zahid Sarwar gave the order on Monday (May 6) after hearing a writ petition filed in this regard.
Last week, Supreme Court lawyer Abdur Razzak filed the writ, seeking instructions to take action against these unlicensed brick kilns.
Razzak said that in order to take legal measures to protect the agriculture and environment of Gaibandha, an application was sent to the Rangpur divisional office of the Department of Environment for the information about illegal brick kilns in the district.
Then on March 18, the office provided written information to the lawyer, mentioning that there are 179 illegal brick kilns in the district.
According to the information, Deputy Commissioner Kazi Nahid applied on April 2 to recover the cropland through demolishing the brick kilns.
The authorities concerned have not taken any action to evict the illegal brick kilns as per the application
Later, lawyer Abdur Razzak sent a legal notice. As no action was taken yet, he filed the writ.
