The Appellate Division (AD) of the Supreme Court (SC) on Wednesday cleared the way for holding the Dhaka University Central Students' Union (DUCSU) election as per its declared schedule.

The apex court upheld until October 30 this year its chamber judge's decision that halted a High Court (HC) directive to suspend the DUCSU election.

A seven-member bench of the AD, headed by Chief Justice Dr Syed Refaat Ahmed, passed the order after hearing a petition, filed by the Dhaka University (DU) authorities seeking a stay on the HC order.

Now there is no legal bar to hold the DUCSU election on September 9 following the apex court order, said lawyer Mohammad Shishir Manir, who represented the DU during the court proceedings.

Following a writ petition, the HC on Monday stayed the DUCSU election process and final voter list until October 30. The order pushed the election into an uncertainty. However, within an hour, the chamber judge of the AD halted the HC order, until filing of a civil miscellaneous petition.

After filing of the petition, the chamber judge sent the matter to the regular AD bench on Tuesday, and set Wednesday for hearing on it. Stay order on the HC directive was also extended until this time.

The writ petition was filed challenging the legality of S M Farhad's candidacy for general secretary post in the DUCSU election, as a nominee from the Islami Chhatra Shibir-backed panel.

B M Fahmida Alam, liberation war and democratic movements affairs secretary candidate from the left alliance panel, filed the petition - saying that Farhad had connection with banned outfit Bangladesh Chhatra League.
