Experts focus on legal due diligence in real estate deals

A hybrid (both virtual and physical) seminar on real estate dispute resolution was held on Tuesday, drawing attention to the legal complexities regarding land and property transactions in the country.

The event brought together legal professionals to discuss freehold, leasehold, and development-related property disputes.

Experts opined that legal due diligence - particularly document verification, physical surveys, and land history analysis - is essential before purchasing or leasing property.

Mohammad Amjad Hossain, Department Head, Dispute Resolution, Rahman's Chambers, shared key insights on the land laws of Bangladesh, including acts like the Real Estate Development and Management Act 2010, the Transfer of Property Act 1882, and the State Acquisition and Tenancy Act 1950.

The presentation also focused on dispute resolution, outlining the roles of courts, land tribunals, and alternative dispute resolution (ADR) methods in resolving issues like ownership, possession, and tenancy disputes.

He also discussed the practical difficulties of dealing with land-related issues due to lack of a centralised digital database.
