The High Court on Sunday cleared the way for the lower court concerned to continue the trial proceedings of a case filed against former BNP lawmaker Hafiz Ibrahim on the charge of possessing a Rajuk plot through providing false information.
The HC lifted its 2019 stay order on the trial proceedings and ordered the lower court to complete the trial of the case in six months.
The HC bench of Justice Md Nazrul Islam Talukder and Justice Mohammad Showkat Ali Chowdhury delivered the verdict after rejecting a revision petition filed by Hafiz challenging the lower court order that framed charges against him in this case.
Senior lawyer Khurshid Alam Khan appeared in the court hearing on behalf of the Anti-Corruption Commission (ACC), while lawyer Sabbir Hamza argued for Hafiz Ibrahim and Deputy Attorney General AKM Amin Uddin Manik represented the state.
Later, Deputy Attorney General Amin Uddin said that the High Court has rejected the revision petition filed by Hafiz Ibrahim challenging the lower court order that framed charges against him in this case. Now the proceedings of the case will continue in the lower court concerned, added the state lawyer.
On March 13, 2017, the Anti-Corruption Commission (ACC) filed the case with Motijheel Police Station against Hafiz, claiming that he took a five-katha plot of Rajuk in 2005, providing false statements and violating the breach of trust, although he, as a lawmaker, was committed to protecting public property.
The Special Court-4 in Dhaka framed charges against Hafiz on January 23, 2019, in the case. Then Hafiz Ibrahim moved the High Court, challenging the charge framing order.
Following the revision petition filed by Hafiz, the HC on April 16, 2019, stayed the trial proceedings of the case and issued a rule asking the state and ACC to explain why the charge framing against him should not be declared illegal.
