Plea seeks HC's interference over 'mystery girl'

An application was placed before the High Court on Tuesday seeking its interference over the incident of a teenage girl who was said to have been murdered but rescued alive on Monday last, 51 days after she went missing from Bandar upazila of Narayanganj.

The application has questioned the accuracy, legitimacy and rationality of an abduction case her father filed with the Narayanganj Model Police Station after the disappearance of the girl.

It also questioned the legality of the confessional statements of the three accused arrested in connection with the abduction case.

Advocate Mohammad Shishir Manir, a Supreme Court lawyer, submitted the application on behalf of five other SC lawyers -- Md Asad Uddin, Md Jobayedur Rahman, Md Ashraful Islam, Md Al Reza Amir and Md Misbah Uddin.

The lawyers sought the High Court's interference over the incident under Section 435 and 439 of the Code of Criminal Procedure (CrPC).

They also sought the High Court's direction calling for the case records.

Lawyer Shishir Manir said their application is an exceptional one because the step that has been initiated by them in the wake of the incident is not in line with the norms. However, the High Court has the jurisdiction to exercise its power in some exceptional cases, he added.

The Deputy Commissioner, the Chief Judicial Magistrate, the Police Commissioner of Narayanganj, the Officer in-Charge of Sadar Police Station, the Investigation Officer of the case, the complainant and the accused have been made respondents to the petition.

Three accused arrested in the case gave confessional statements on August 9 under Section 164 in separate courts in Narayanganj. In their confessional statements, the accused said they had killed the minor girl after rape and dumped her body in the Sitalakhya River.
