A Dhaka court on Wednesday rejected the bail petition filed by BNP Secretary-General Mirza Fakhrul Islam Alamgir in connection with a case filed over the attack on the residence of the Chief Justice during October 28 violence.
Judge (in charge) of Dhaka Metropolitan Sessions Judge's Court in Dhaka Faisal Atiq Bin Quader passed the order, after hearing the bail petition, said Barrister Bodruddoza Badal who appeared in the court proceedings for Mirza Fakhrul.
Advocate Masud Ahmed Talukder, Advocate Md Asaduzzaman, Advocate Iqbal Hossain and others also took part in the hearing on behalf of Mirza Fakhrul.
During the hearing Barrister Bodruddoza said Fakhrul is now 81 years old and he has been suffering from various ailments including cardiac issues, and he was not present during the vandalism.
The prosecution did not mention his involvement specifically, so his bail petition should be granted, the lawyer said.
Opposing the bail petition, Public Prosecutor for the Dhaka Metropolitan Magistrate Court Abdullah Abu told the court that as per the direction and instigation of Mirza Fakhrul and other top BNP leaders, party leaders and activists had committed offences including attacking the chief justice' residence.
Upon holding hearing from both the sides, the judge rejected the bail petition.
BNP Secretary General Mirza Fakhrul Islam Alamgir on November 2 filed the bail petition with the Metropolitan Sessions Judge's Court in connection with the case filed over the attack on the residence of the Chief Justice in Kakrail.
His lawyer Zainul Abedin Mesbah filed the petition with the court of Dhaka Metropolitan Sessions Judge, Md Assaduzzaman, seeking bail for Fakhrul in the case filed with the Ramna Police Station.
Earlier on October 29, a Magistrate Court rejected a bail petition filed by Mirza Fakhrul in the case. Later the petition was filed with the Metropolitan Sessions Judge's court against the order passed by the Metropolitan Magistrate Court.
On October 29, the Detective Branch of police detained Fakhrul from his Gulshan residence around 9:25am. That day around 10:00pm, Dhaka Metropolitan Magistrate Md Rashidul Alam sent him to jail, rejecting his bail prayer after he was produced before the court.
