The High Court on Tuesday issued a rule as to why the gazette notification that demarcates the Noakhali-1 constituency by excluding from it Bazra Union of Sunaimuri upazila should not be declared illegal.
The chief election commissioner (CEC) and others concerned have been asked to respond to the rule within four weeks.
The rule follows a writ petition filed by Barrister AM Mahbub Uddin Khokan, also a former MP of the Noakhali-1, among others.
It was passed by the High Court bench of Justice K M Kamrul Kader and Justice Mohammad Showkat Ali Chowdhury after hearing the petition.
Earlier in June this year, the Election Commission had issued a gazette notification redrawing 10 parliamentary constituencies, including Noakhali-1, ahead of the upcoming general election to be held at the end of the year or early next year.
As per the notification, the Noakhali-1 constituency was redrawn by excluding from it the Bazra Union of Sunaimuri upazila and thereby including in Noakhali-2.
