The High Court on Tuesday directed the authorities concerned not to ask for the waiver certificates from vessels failing under section 3 (1) (a), (c), and (d) of the Bangladesh Flag Vessel (protection of interest) Act, 2019 for the next six months.
As per the Rule-3 of the Bangladesh Flag Vessel (protection of interest) Act, 2019 foreign ocean-going container vessels require a waiver certificate from the office of the Mercantile Marine Department under the Department of Shipping.
The HC bench of Justice Sheikh Hassan Arif and Justice Md Bazlur Rahman passed the order after hearing a writ petition filled in this regard.
The court also issued a rule upon the government to explain as to why the Rule-3 of Bangladesh Flag Vessels (protection of interest) requiring all the vessels to obtain waiver certificates for carrying goods shall not be declared unconstitutional.
